Law Applicable to Extradition

Extradition:

The fugitive can be admitted to bail in the state where he is seeking asylum, ARS 13-3856.

Requisition of fugitive is within 90 days, ARS 13-3855 (30 days) plus ARS 13-3857 (60 days).

Local criminal charges toll requisition period, ARS, 13-3859.01.

Guilt or innocence may not be inquired into except to contest fugitive’s identity, ARS 13-3860.

The burden of disproving identity is on the fugitive, Ex Parte Freeman, 80 Ariz. 21 (Ariz. 1955).

During Habeas Corpus requisition time is tolled, State v. Wright, 112 Ariz. 446 (Ariz. 1975).

Federal law controls regarding interstate extradition, State v. Hooker, 128 Ariz. 479 (Ariz. 1981).

If Arizona detains an inmate out of state, the inmate receives credit for the length of detention towards the inmate’s open Arizona charge, State v. DePasquallo, 681 P. 2d 387 (1983 Ariz. App.).
