Law Applicable to Expungement of Convictions

A.R.S. 13-907. A. allows "the judge... who pronounced sentence... to... set aside" certain offenses.

A.R.S. 13-912 automatically restores a first time felony offender's civil rights after the completion of probation or absolute discharge from prison. This does not apply to the right to possess weapons including firearms.

A.R.S. 13-4051.A. provides that a person who has been wrongfully "arrested, indicted or otherwise charged," can have the person's record cleared by petitioning the Superior Court. There must have been "no legal basis for the arrest, or no legal or factual basis for the charge, or where the parties so stipulate (State v. Franco, 153 Ariz. 424, 426 (Ariz.App. 1987))."
