Law Applicable to Appeals

Ariz.R.Crim.P. 31.3. "The notice of appeal shall be filed with the clerk of the trial court within 20 days after the entry of judgment and sentence."

The court can allow an untimely filing when Defendant demonstrates that the untimely filing was not Defendant's fault, Roe v. Flores-Ortega, 528 U.S. 470, Versuslaw paragraph 63 (2000).

Ariz.R. 31.19.a. "Within 30 days after the filing of a decision...any party may file....a petition for review by the" Arizona Supreme Court.

United States Supreme Court Rule 13. "[A] petition for a writ of certiorari...is timely when it is filed... within 90 days after entry of the judgment."

United States Supreme Court Rule 10. "A petition for a writ of certiorari will be granted only for compelling reasons," some of which may include (a) conflicting decisions between federal appellate courts. (b) Conflicting decisions between state supreme courts. (c) A state supreme court decision "has... departed from... the accepted and usual course of judicial proceedings." (d) A state supreme or federal appeals court has made a decision contrary to United States Supreme Court precedent.
