Suspect has 2 control a vehicle before charged with
DUI, State v. Love, 182 Ariz. 324 (Ariz. 1995).
Police need an articulable suspicion to stop a suspect,
State v. Graciano, 134 Ariz. 35 (Ariz. 1982).
In custody without Miranda, statements inadmissible,
Berkemer v. McCarty, 468 U.S. 420, (1984).
Suspect can talk to lawyer before taking the breath
test, State v. Juarez, 161, Ariz. 76 (Ariz. 1989).
Refusal to take a breath test is admissible, State
v. Superior, 165 Ariz. 275 (Ariz.App. 1987).
Retrograde extrapolation is valid 2 + hrs. after
vehicle stop, State v. Panveno, (Ariz.App. 1999).
Exception to speedy trial rule, State v. Mendoza,
170 Ariz. 184 (Ariz. 1992).
Knowledge of license suspension is needed for Aggravated
DUI, State v. Agee, 181 Ariz. 588 (Ariz.App.1994).
The accused has a "due processs right to gather
independent evidence of sobriety (State v. Rosengren, 14
P. 3d 303, Versuslaw paragraph 37 (Ariz.App.2000))."
